Terms & Conditions of Charter

1. Operator

WEST.navy is operated by West Navy Charter Ltd., a private limited liability company registered in Malta under company number C 116561, registered office 152, No.9, Naxxar Road, San Gwann, SGN 9030 Malta. Email: contact@west.navy. Referred to below as “we”, “us” or “the Operator”.

2. Scope

These Terms apply to every booking of a skippered day–charter outing (“Charter”) made through this website or its online booking engine. Every Charter is operated with a professional skipper proposed by the Operator and agreed by the customer. Each Charter is a single-day, skippered outing on the water, without accommodation or overnight stay. West Navy Charter Ltd. provides only the vessel and its professional skipper — a single nautical leisure service — and does not sell, organise or include any combination of transport, accommodation or package of travel services; the price covers this service alone.

3. Booking and payment

Bookings are made online through our booking engine. A booking is firm only once you have received a written confirmation and full payment of the Charter price (100%) has been received. Any additional amounts — such as fuel, settled at actual consumption, and any agreed extras — are payable on the day of the Charter. Prices are shown in euros, inclusive of any applicable taxes, and cover the professional skipper and standard on-board safety equipment. Fuel is not included and is settled at the end of the Charter based on actual consumption. Extras (catering, additional hours, special requests) are quoted separately.

4. The Charter

Each Charter is run by a professional skipper who remains in command of the vessel at all times. The published guest capacity is the maximum number of persons on board, including children. The route is agreed between the customer and the skipper, according to the time available, the customer's wishes and any reservations made (restaurants, beach clubs and similar). Any such shore arrangements are the customer's own, decided during the outing and paid directly by the customer; they are not sold, organised or included by the Operator and do not form part of the Charter price. The itinerary remains indicative and may be adjusted by the skipper for reasons of safety, weather, sea state or navigation rules.

5. Guest obligations and conduct

Guests must follow the skipper’s safety instructions at all times. The skipper may refuse boarding to, or disembark, any person who is intoxicated, behaves dangerously or endangers others, without refund. Swimming, diving and water activities are undertaken at guests’ own risk and only when authorised by the skipper. Guests are responsible for their personal belongings.

6. Changes and cancellation by the client

Any change or cancellation must be requested in writing. The following refund schedule applies to cancellations by the client:

  • more than 14 days before departure – 95% of the price is refunded;
  • between 14 and 5 days before departure – 50% of the price is refunded;
  • less than 5 days before departure, or no-show – no refund.

We recommend that guests take out personal cancellation or travel insurance.

7. Cancellation by the Operator – weather and safety

Safety comes first. If, in the skipper’s sole judgement, weather, sea conditions or other circumstances make the Charter unsafe, we may cancel it, shorten it or propose another date. Where we cancel a Charter before departure for such reasons, you may choose between rescheduling and a refund of the sums paid for the canceled Charter. Where a Charter has begun and is shortened for safety, a pro-rata refund applies. The refund schedule in clause 6 applies only to cancellations made by the client for their own reasons: where a Charter cannot safely go ahead because of weather or sea conditions, you are entitled to a free reschedule or a refund even within the periods set out in clause 6. We are not liable for incidental costs such as travel or accommodation.

8. Force majeure

We are not liable for any failure to perform caused by events beyond our reasonable control, including severe weather, port closure, orders from the authorities or strikes.

9. Right of withdrawal

Under the EU Consumer Rights Directive (2011/83/EU), as transposed into Maltese law, the right of withdrawal does not apply to contracts for services related to leisure activities that provide for a specific date or period of performance. A confirmed Charter booking is therefore final, subject to the cancellation terms above.

10. Liability and insurance

Each vessel offered through WEST.navy is insured by its owner, including for commercial charter use with paying passengers. The professional skipper operating the Charter holds his or her own professional liability insurance. West Navy Charter Ltd. holds professional and operating liability insurance (responsabilité civile professionnelle et exploitation) covering its activity as organiser and seller of the Charter. To the extent permitted by law, our liability is limited to the price of the Charter and excludes indirect or consequential loss. Nothing in these Terms limits liability for death or personal injury caused by our negligence, or any liability that cannot be excluded by law. Personal belongings brought aboard remain the responsibility of guests.

11. Children, alcohol and health

Minors must be accompanied by a responsible adult. Lifejackets are provided for all guests. Please tell us before the Charter of any condition (reduced mobility, pregnancy, medical condition) that may affect safety on board. Excessive alcohol may lead to refusal of boarding.

12. Complaints and dispute resolution

Any complaint should first be sent to contact@west.navy. If no solution is found, you may refer the matter to the Office for Consumer Affairs within the Malta Competition and Consumer Affairs Authority (MCCAA), or to a competent alternative dispute resolution (ADR) entity. (The EU Online Dispute Resolution platform was discontinued on 20 July 2025 and is intentionally not referenced.)

13. Intellectual property

All content on this website — texts, photographs, logos and design — is protected and may not be reproduced without our written permission.

14. Governing law

These Terms are governed by the laws of Malta. As a consumer, you keep the right to bring proceedings before the courts of your place of residence and to rely on the mandatory consumer-protection rules of that country.
